New Laws for New York in 2022

Several new bills approved at the state Capitol impacting NYC residents are taking effect in 2022. Here are some of the most significant ones affecting New Yorkers this year: 

City Laws

  • Salary Laws: Employers in NYC will be required to mention the minimum and maximum starting salaries for all job openings by April 2022. Failure to do so can result in a fine.
  • Delivery Driver Protections: Door Dash, Grub Hub, and other food delivery services will now be required to provide minimum delivery payments for their drivers and eliminate fees to access trips by January 24. Restaurants in NYC will also need to provide access to restrooms. 

State Laws

  • Styrofoam Ban: As of January 1, most styrofoam packaging is banned across New York State. The ban includes containers, packaging peanuts, and other single-use foam containers. The law states that the first violation will cost businesses up to $250. A second will cost businesses up to $500 and/or a third violation up to $1,000. According to the Department of Environmental Conservation, fines collected will be put into the Environmental Protection Fund. 
  • Employee Monitoring: Employers will now be required to tell employees if their internet, email, or phone usage is being monitored. Refusing to do so will result in fines up to $3,000. This law will officially take effect May 7. 
  • Whistleblower Protection: New whistleblower laws went into effect this year to protect workers reporting criminal actions of employers. The laws also apply to former employees who have experienced ‘retaliatory act.’
  • NYC Paid Family Leave: New Yorkers can now apply for up to 12 weeks of paid time off to care for a new child or sick family member through the NYC Paid Family Leave program. Employees taking leave will receive 67% of their average weekly rate starting January 1.
